TERMS AND CONDITIONS

1. 1 PRELIMINARY REMARKS

We are delighted by your interest in Airtime & Saltyfeet's offerings. Airtime & Saltyfeet offers paragliding and kitesurfing trips. Our paragliding trips are exclusively for licensed paragliding pilots.

 

Paragliding and kitesurfing are considered safe sports and are therefore not classified as high-risk sports by Swiss accident insurance companies. When practiced with due care, paragliding and kitesurfing are safe sports. We accept this responsibility and expect you, as our customer, to do the same and take responsibility for your own safety. You should do everything possible to ensure that you do not endanger yourself, other participants, or uninvolved persons during the trip, and/or prevent them from carrying out their activities, in particular by fulfilling all safety, health, and legal requirements.

 

By accepting your booking with Airtime & Saltyfeet, a contract is formed between you and Airtime & Saltyfeet. These terms and conditions form part of this contract. Please read them carefully. Only the masculine form is used in this text; however, the feminine form is always implied.

1.2 REGULATIONS

These General Terms and Conditions of Contract and Travel govern the legal relationship between you (participant) and Airtime & Saltyfeet.

 

 

2. CONCLUSION OF CONTRACT

2.1 COMMENCEMENT OF CONTRACT

The contract between you and Airtime & Saltyfeet is concluded upon the unconditional acceptance of your written, telephone, or in-person registration with Airtime & Saltyfeet. Registration is considered confirmed upon dispatch of written confirmation by Airtime & Saltyfeet. From this point on, the rights and obligations arising from the contract (including these General Terms and Conditions of Contract and Travel) become effective for you and Airtime & Saltyfeet.

 

2.2 SCOPE OF APPLICATION

If the person making the booking registers additional participants, they are liable for their contractual obligations (in particular, payment of the travel price) as if they were their own.

 

 

3. SERVICES

Our services are detailed in the brochure or on our company website and in your travel documents. Any special requests or supplementary agreements you may have are only valid if confirmed in writing and without reservation by Airtime & Saltyfeet.

 

Unless otherwise stated in the travel description, Airtime & Saltyfeet's services begin at the agreed-upon airport for air travel and at the boarding point for bus travel.

You are responsible for your own travel arrangements, arriving on time, and complying with the requirements of the transport company (e.g., airline).

 

 

4. PRICES AND PAYMENT TERMS

4.1 PRICES

Prices for travel packages are listed in the catalog and on the website for each destination. Unless otherwise stated in the offer, prices for travel packages are per person in Swiss francs, plus applicable VAT. Accommodation is in a double room. Single rooms are available for a surcharge. The prices valid at the time of booking apply. For price changes, please see section 6.

 

4.2 DEPOSITS

Airtime & Saltyfeet waives the requirement for deposits from customers whenever possible. However, for certain trips and in situations determined by Airtime & Saltyfeet, a deposit may be required.

 

4.3 PAYMENT OF TRIP PRICE

Payment for the trip price (or the remaining balance for deposits as per section 4.2) is due no later than 30 days after receipt of the invoice.  If payment is not received on time, Airtime & Saltyfeet may refuse to provide the travel services and charge processing fees in accordance with sections 5.2 and 5.3.

 

4.4 SHORT-TERM BOOKINGS

If you book your trip less than 30 days before departure, the entire invoice amount is due immediately.

 

4.5 BOOKING FEES AND PLACEMENT FEES

Airtime & Saltyfeet generally does not charge booking fees or order fees.

 

For special requests requiring significant processing, a processing fee of up to CHF 60 may be charged. For researching and booking flights that are not part of a trip, Airtime & Saltyfeet charges a processing fee of up to CHF 100.

 

4.6 TRAVEL DOCUMENTS

Unless otherwise agreed, your travel documents will be sent to you after receipt of your payment for the full invoice amount and approximately 10 days before the start of your trip.

 

 

5. CHANGES/CANCELLATION OF THE TRIP PROGRAM

5.1 GENERAL

If you cancel your trip or wish to change or rebook your booked trip, you must inform Airtime & Saltyfeet personally and immediately.

 

5.2 PROCESSING FEE

A processing fee of at least CHF 40 per person and a maximum of CHF 120 per booking will be charged for cancellations, changes, or rebookings of your trip. The surcharge depends on the amount of work involved (see also section 5.3). These processing fees are not covered by any existing trip cancellation insurance.

 

5.3 CANCELLATION FEES

If you cancel your trip within the following timeframes before departure, the following cancellation fees will be charged in addition to the processing fees (section 5.2):

 

The date your cancellation or change notice is received by Airtime & Saltyfeet is decisive for calculating the cancellation or change date; for Saturdays, Sundays, and public holidays, the next business day applies.

• 60 to 30 days before departure: 25% of the package price;

• 29 to 15 days before departure: 50% of the package price;

• 14 to 0 days before departure: 100% of the package price.

 

We recommend taking out cancellation insurance, which will reimburse any cancellation costs in cases of hardship (illness, accident, death, force majeure) according to the insurance terms and conditions.

 

5.4 Substitute Participant

If you are unable to participate in the trip, you may nominate a substitute participant. The substitute participant must be willing to assume the contract under the existing terms and conditions.

 

The processing fee (section 5.2) and any additional costs incurred are jointly and severally liable to you and the substitute participant.

5.5 Insurance

Insurance is not included in the price or services.

 

Participants are expressly responsible for obtaining their own cancellation and repatriation insurance. By commencing the trip, participants confirm that they will bear all costs arising from accidents and illness during the trip, as well as rescue and repatriation. Airtime & Saltyfeet strongly recommends that all participants obtain comprehensive insurance coverage (including repatriation services in case of accidents, such as those offered by REGA or ADAC/ETI).

 

5.6 LIABILITY INSURANCE

By registering for an event with Airtime & Saltyfeet, participants confirm that they have mandatory liability insurance for owners and users of hang gliders and parachutes, valid in the respective country of travel, with a coverage limit of CHF 2,000,000 per incident.

Kitesurfing (as a kiteboard) is legally equivalent to sailing in Switzerland. This means that liability insurance is mandatory. Many standard personal liability insurance policies exclude damages caused by kitesurfing on Swiss waters in their terms and conditions or only offer coverage abroad. Check your policy or protect yourself, for example, by becoming a member of the Kitesurf Club Switzerland, which includes corresponding liability coverage for Swiss lakes.

As a participant, you fly or kite at your own risk. Airtime & Saltyfeet accepts no liability.  Damage to rental and test equipment caused by the participant's own negligence is the sole responsibility of the customer.

6. PROGRAM AND PRICE CHANGES

6.1 CHANGES BEFORE CONCLUSION OF CONTRACT

Airtime & Saltyfeet expressly reserves the right to change service descriptions and prices before you book. Should this be the case, Airtime & Saltyfeet will inform you of these changes before the contract is concluded.

 

6.2 PRICE CHANGES AFTER CONCLUSION OF CONTRACT

In exceptional cases, it may be necessary to increase the agreed price. Price increases may result from:

            a) subsequent increases in transportation costs (including fuel surcharges);

            b) newly introduced or increased government taxes or fees (such as airport taxes, landing fees,    embarkation and disembarkation fees, etc.);

            c) exchange rate fluctuations;

            d) government-mandated price increases (e.g., value-added tax);

            e) small group tours that are conducted below the advertised minimum number of participants.

 

If the costs of these travel services increase, they may be passed on to you. The tour price will increase accordingly.

 

Airtime & Saltyfeet will implement the price increase no later than 30 days before the start of the tour. If the price increase exceeds 10 percent, you are entitled to the rights outlined in section 6.4.

6.3 PROGRAM CHANGES AFTER YOUR

BOOKING AND BEFORE THE START OF THE TRIP

Paragliding and kitesurfing are weather-dependent outdoor sports. Airtime & Saltyfeet reserves the right, also in your interest, to change the tour program or individual agreed-upon services (such as destination, accommodation, mode of transport, means of transport, airlines, flight times, etc.) if circumstances require it.

 

Airtime & Saltyfeet will endeavor to offer you equivalent alternative services.  In particular, Airtime & Saltyfeet is not liable for changes to the itinerary due to force majeure or official measures for which Airtime & Saltyfeet is not responsible.

 

Airtime & Saltyfeet will inform you of such changes and their impact on the price as soon as possible.

 

6.4 YOUR RIGHTS IF PRICE OR PROGRAM CHANGES ARE MADE AFTER CONCLUSION OF THE CONTRACT

If the program change or the change to individual agreed services results in a significant change to an essential contractual point or if the price increase exceeds 10 percent, you have the right to withdraw from the contract within 5 days of receiving our notification. You will receive an immediate refund of the travel price already paid (or the deposit).

 

 

7. TRIP CANCELLATION BY AIRTIME & SALTYFEET

7.1 MINIMUM NUMBER OF PARTICIPANTS

All trips offered by Airtime & Saltyfeet require a minimum number of participants. If fewer than the required minimum number of participants sign up for a trip, Airtime & Saltyfeet may cancel the trip no later than 20 days before the scheduled departure date. If Airtime & Saltyfeet proceeds with the trip despite having fewer participants, this is not grounds for cancellation by the participant.

 

7.2 FORCE MAJEURE, STRIKES

Events of force majeure (e.g., natural disasters, epidemics, civil unrest), government measures, or strikes may cause Airtime & Saltyfeet to cancel the trip. In such a case, Airtime & Saltyfeet will inform you as soon as possible.

 

If the trip is canceled, Airtime & Saltyfeet will endeavor to offer you an equivalent alternative trip. Further claims for compensation are excluded.

 

7.3 Trip Cancellation by Airtime & Saltyfeet for Other Reasons

Airtime & Saltyfeet reserves the right to cancel the trip for other reasons, particularly due to adverse weather conditions. Should this occur, you will be informed as soon as possible and no later than 7 days before departure.

 

 

8. Program Changes and Service Disruptions During the Trip

8.1 Program Changes

Should a program change be made during the trip (e.g., due to weather conditions), Airtime & Saltyfeet will not provide compensation. Airtime & Saltyfeet will endeavor to conduct the trip with equivalent services. However, safety is always the top priority.

 

8.2 SKILL LEVEL

Should the selected skill level be too high for a participant, the tour guide may, in the interest of the group, refuse participation

in the tours. They will endeavor to offer an alternative program. The costs for this will be borne by the participant. In any case, a solution satisfactory to both parties will be sought.

 

 

9. TRIP TERMINATION

Should you terminate your trip prematurely for any reason, the price of the travel arrangements cannot be refunded.

In urgent cases (e.g., your own illness or accident, serious illness or death of a close relative), the tour guide or service provider will assist you, to the extent possible, in organizing your early return.

 

 

10. COMPLAINTS

10.1 COMPLAINTS AND REQUESTS FOR REMEDY

If the trip does not conform to the contractual agreement or if you suffer any damage, you are obligated to immediately report this defect or damage to the tour guide and request free redress. The tour guide will endeavor to provide a remedy.

If you wish to make a claim for defects, refunds, or damages against Airtime & Saltyfeet, you must submit your complaint in writing to Airtime & Saltyfeet within 30 days of your return. Any supporting evidence must be included with your complaint.

 

11. OBLIGATIONS TO COOPERATION

11.1 PERSONAL REQUIREMENTS

It is essential that you adapt to the customs and traditions of foreign countries when traveling there. The tour guide may exclude participants who significantly disrupt the group or do not comply with the rules of the destination country from the trip. Any return travel costs will be borne by the participant, and the paid trip price will not be refunded.

 

11.2 HEALTH AND LEGAL REQUIREMENTS

Good health is a prerequisite for participation in paragliding and kitesurfing trips. Should a participant not meet the requirements or not be adequately licensed, the tour guide is authorized to refuse participation in the trip.

 

Any return travel costs will be borne by the participant, and the paid trip price will not be refunded.

 

11.3. KITE-SURVEYS & CONDITIONS

Participation in the kitesurfing courses and packages we offer requires mental and physical fitness. All participants must be able to swim. During kitesurfing lessons, participants must follow the instructions of the instructors and supervisors. Failure to comply will result in immediate exclusion without refund.

 

Participants take part in kitesurfing courses at their own risk and must comply with all local, national, and international safety guidelines and legal regulations.

 

11.4. EQUIPMENT

Participants in paragliding and kitesurfing trips are responsible for ensuring their equipment is in good working order and complete. Participants must bring their own fully functional equipment to participate in paragliding and kitesurfing trips. If a participant does not meet these requirements (e.g., lack of a reserve parachute, head protection, etc.), the tour guide is authorized to refuse participation.  Any return travel costs are the  responsibility of the participant, and the paid travel price is non-refundable. Exceptions apply to bookings of kitesurfing courses. Kitesurfing courses include rental equipment and safety gear in the price.

 

 

12. LIABILITY OF AIRTIME & SALTYFEET

12.1 GENERAL

Airtime & Saltyfeet will reimburse you for the value of agreed-upon but unprovided services, provided that the tour guide was unable to provide an equivalent replacement service on site.

 

12.2 SAFETY

You participate in your sport at your own risk. Airtime & Saltyfeet accepts no liability for resulting accidents and/or personal injuries. Participants assume full responsibility for all self-piloted paragliding flights. You are responsible for complying with all applicable national regulations and laws, even when traveling with a group.

 

12.3 LIMITATIONS OF LIABILITY, EXCLUSIONS

12.3.1 INTERNATIONAL AGREEMENTS AND NATIONAL LAWS

If international agreements and national laws contain limitations on compensation for damages arising from non-performance or improper performance, Airtime & Saltyfeet may invoke these and is liable only within the scope of these agreements. International agreements and national laws with limitations and exclusions of liability exist, in particular, in the transportation sector (such as air transport, maritime shipping, and rail transport).

 

12.3.2 EXCLUSIONS OF LIABILITY

Airtime & Saltyfeet is not liable if the non-performance or improper performance of the contract is due to the following causes:

            a) negligence on your part before or during the trip;

            b) Unforeseeable or unavoidable failures of a third party not involved in providing the contrac            tually agreed service;

            c) Force majeure, weather conditions, or any event that Airtime & Saltyfeet could not        foresee            or prevent despite exercising due diligence. In these cases, any liability     for damages on the    part of Airtime & Saltyfeet is excluded.

 

Airtime & Saltyfeet and its staff are not liable for damages to participants resulting from simple negligence. This exclusion of liability applies regardless of the cause and circumstances of the damage, as well as the type and amount of the damage. Participants are responsible for ensuring that their paragliding pilot licenses are valid. Participants are responsible for ensuring that their flying equipment is airworthy. Participants are responsible for ensuring that their  kitesurfing equipment is in a condition suitable for safe use. Airtime & Saltyfeet is not liable for damage to or theft of participants' personal equipment in Airtime & Saltyfeet vehicles (including trailers).

 

Damage to loan and test equipment caused by the customer's own negligence will be fully borne by the customer.

 

12.3.3 PERSONAL INJURY, ACCIDENTS, AND ILLNESS

Airtime & Saltyfeet is liable for personal injury, death, bodily injury, and illness resulting from non-performance or improper performance of the contract, provided that such injury or illness is attributable to the fault of Airtime & Saltyfeet. International agreements and national laws remain reserved (Section 12.3.1).

 

Contractual limitation of liability regarding health-related harm: Airtime & Saltyfeet and its staff assume no liability for any health-related harm arising in connection with the provision of services during a kitesurfing or parakiting course. All participants are informed in advance of the risks associated with the event and the sport of kitesurfing or parakiting, and must agree to assume full liability by signing upon registration.

12.3.4 DAMAGE TO PROPERTY AND FINANCIAL LOSS

In the event of damage to property or financial loss arising from non-performance or improper performance of the contract, Airtime & Saltyfeet’s liability is limited to a maximum of twice the price of the trip, unless the damage was caused intentionally. Lower liability limits or exclusions of liability contained in international conventions and national laws remain reserved.

12.3.5 BUS, TRAIN, AND FLIGHT SCHEDULES

Even with careful travel planning, we cannot guarantee adherence to these schedules. Delays may occur, particularly due to heavy traffic, traffic jams, accidents, airport congestion, diversions, delayed border clearance, etc. We accept no liability in any of these cases.

 

12.3.6 Flight delays

In the event of flight delays, the airline is liable in accordance with the Montreal Convention.

 

12.4 EVENTS AND EXCURSIONS DURING THE TRIP

Local events or excursions may be available for booking during the trip, outside of the agreed travel itinerary. Please be aware that such events and excursions may involve risks. Participation in such events and excursions is entirely at your own discretion and responsibility.

 

These General Terms and Conditions of Contract and Travel apply to events or excursions organized by Airtime & Saltyfeet. However, if Airtime & Saltyfeet is not your contractual partner, you cannot rely on these General Terms and Conditions—particularly if the events or excursions are organized by third-party companies and the tour guide merely facilitated the booking.

 

12.5 FDFA List

The Federal Department of Foreign Affairs (FDFA) regularly publishes information on countries where there may be security-related or other significant risks. These travel advisories can be accessed via the FDFA website at www.eda.admin.ch. Ultimately, each participant must decide for themselves whether or not they wish to travel.

 

 

13. ENTRY AND VISA REQUIREMENTS

13.1 PERSONAL RESPONSIBILITY

Each participant is personally responsible for informing themselves about passport and entry requirements and for taking the necessary steps to be able to undertake the journey in compliance with country- and origin-specific regulations. This also includes checking the regulations of countries where transit or a stopover takes place.

 

13.2 UNAVAILABILITY OF TRAVEL DOCUMENTS

If a travel document cannot be obtained or is issued too late, and you are consequently forced to cancel the trip, the cancellation terms (pursuant to Section 5) shall apply.

 

13.3 COMPLIANCE WITH REGULATIONS

Participants are personally responsible for complying with entry, health, and foreign exchange regulations. This also applies to transit countries. Airtime & Saltyfeet cannot be held liable if entry is refused by the authorities.

 

13.4 REFUSAL OF ENTRY AND VIOLATION OF THE LAW

Airtime & Saltyfeet wishes to inform you that, in the event of a refusal of entry, you are responsible for covering the costs of the return journey. Furthermore, Airtime & Saltyfeet expressly points out that all participants are solely responsible for informing themselves about legal regulations and complying with them.

 

 

14. DATA PROTECTION

The participant consents to the electronic processing and storage of their data by Airtime & Saltyfeet within the scope of the contractual relationship. Data will not be disclosed to third parties without authorization. The participant is advised that, given the current state of technology, it is impossible to completely rule out the risk of unauthorized parties gaining access to data during transmission over the Internet.

 

 

15. APPLICABLE LAW, PLACE OF JURISDICTION, AND SEVERABILITY CLAUSE

Swiss law applies to the legal relationship between you and Airtime & Saltyfeet.The place of performance and jurisdiction is the Regional Court of Engadina Bassa/Val Müstair.The invalidity of individual provisions of the travel contract does not render the entire contract invalid.
